Welcome to Meldmi! These Terms of Use govern your use of our platform, where you can create and view public reports. By registering and using our services, you agree to these terms.
1. Acceptance of the Terms
We, the users of Meldmi (hereinafter also referred to as "you"), expressly accept these Terms of Use (hereinafter referred to as "Terms") of Meldmi (hereinafter referred to as "the Operator"). Further use of the platform is solely subject to compliance with these Terms. Users' own terms of use do not apply.
2. Definitions
- User: Persons who register with Meldmi and use the services.
- Content: Any information, data, texts, software, music, sounds, photos, graphics, videos, messages, or other materials published or transmitted on the platform.
- Report: An entry describing issues or disruptions in public spaces created by registered users.
3. Use of the Platform
3.1 Purpose, Scope, Exceptions
Our platform is exclusively for reporting problems, difficulties, or disruptions in public spaces (hereinafter referred to as "Reports"). Reports will only be processed if they fall under the categories listed on the platform and refer to a specific incident. Reports and comments must adhere to the principles of netiquette.
Confidential matters should be directed to the relevant authorities.
The use of the platform is not permitted in the following cases:
- Urgent messages requiring immediate responses (emergencies, danger situations). In such cases, direct contact with the appropriate authorities (fire department, rescue service, police) is required.
- Requests or personal concerns to the relevant authority (e.g., applications, complaints, reports, requests, other inquiries, communications, etc.) must be addressed directly to the respective authority.
- In particular, the use of the platform must not bypass legal deadlines, regulations, guidelines, or solutions.
3.2 Prohibited Content
It is prohibited to publish content that:
- Is offensive, humiliating, harassing, discriminatory, pornographic, political, or religious or endangers the safety of minors;
- Is illegal or unlawfully obtained;
- Is criminally relevant;
- Violates contractual obligations;
- Directly or indirectly reveals the identity of individuals;
- Infringes on the rights of third parties (e.g., intellectual property, personal rights, right to one's own image; content that discloses vehicle registration plates, telephone numbers, email, and postal addresses, etc.);
- Contains advertising;
- Endangers public order and safety;
- Spreads false information (fake news);
- Violates netiquette or is impolite or contrary to good manners.
3.3 Additional Rules and Netiquette
In addition to the above rules, the following provisions apply:
- Formulate your report objectively and respectfully, even if you are upset.
- Ensure that you do not photograph, publish, or post faces, registration plates, or other subjects that could violate privacy.
- Do not publish any content, whether text or images, that could violate or expose others' dignity.
- Do not post documents, emails, texts, images, videos, etc., of third parties without their express written consent.
- Any form of advertising is not allowed.
- In the event of violations of these rules, particularly insults, we reserve the right to remove your contribution.
3.4 Liability and Disclaimer
The Operator is only liable for its own content and only in cases of gross negligence or intent.
The Operator takes no responsibility for third-party content on the platform. Users bear sole responsibility for such content. In case of violations of these Terms, the affected users are obligated to indemnify the Operator against any claims by third parties. In case of criminal acts, the Operator reserves the right to involve law enforcement authorities.
3.5 Communication
The Operator is entitled to proactively inform users (e.g., via email) about news regarding the platform or services and to ask follow-up questions about reports, comments, profiles, etc.
3.6 Further Rights and Obligations of Users
Users have the right to unsubscribe from the platform at any time via email. Editing or deleting own reports and comments after submission is not possible. Reports or comments remain visible even after unsubscribing, provided they comply with the principles of these Terms.
3.7 Use of Content
Users grant the Operator unrestricted rights to use the submitted content. The Operator may display it publicly, store it permanently, and reuse it (particularly to solve problems, promote open administrative data, or for statistical, analytical, or research purposes). The obligation to delete according to applicable data protection regulations remains unaffected.
All rights to the content and the platform itself (design, layout, texts, logo, etc.) remain with the Operator. Further use is only permitted with the express written consent of the Operator. Users may not use other users' content without their express consent.
3.8 Availability of Services
The Operator strives for maximum availability of the services. Interruptions cannot be excluded. No legal claims can be derived from such interruptions. Interruptions due to maintenance, technical disruptions, or force majeure are possible. The Operator reserves the right to restrict, expand, interrupt, or discontinue the services at any time.
4. Modification of the Terms of Use
The Operator reserves the right to change these Terms of Use at any time within the legally permissible framework.
5. Security
The Operator undertakes to take appropriate technical and organizational measures to protect user data and prevent unauthorized access or misuse. These include the use of encryption technologies and secure servers.
6. Consent of Minors
The use of the platform by minors is only permitted with the consent of their guardians. The Operator reserves the right to request proof of this consent.

8. Final Provisions
Should any provision of these Terms of Use, subsequent amendment, or supplement be invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions of the contract.
For all disputes arising from the contract, the court responsible for the Operator's seat has jurisdiction.
The contract is subject to Austrian law, excluding the rules of international private law.
